General Terms and Conditions (GTC)

 

§ 1 Scope

1.1 The operator of this online shop, David Hohenberger, Eitelstraße 26, 10317 Berlin, hereinafter referred to as the Seller, provides all deliveries and services to its contractual partners, hereinafter referred to as the Buyer, exclusively on the basis of these General Terms and Conditions (hereinafter referred to as GTC).

1.2 These General Terms and Conditions apply to consumers and entrepreneurs, unless a distinction is made in the respective clause. In the following, a consumer is defined as any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 new version BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the contract, is acting in the exercise of their commercial or independent professional activity (§ 14 (1) BGB).

1.3 The customer's terms and conditions shall not be recognized unless the seller expressly agrees to their validity in writing.

 

§ 2 Conclusion of contract

2.1 A contract is only concluded when the buyer places an order using the online order form and the seller accepts it. An automatic confirmation of receipt of the order sent to the buyer does not constitute acceptance of the contract. The seller only accepts your order by sending a separate order confirmation by email within 1 to 2 business days.

2.2 By clicking on the shopping cart icon/link, the items selected by the buyer and placed in the “shopping cart” can be viewed. The items stored in the shopping cart can be accessed and removed.

2.3 By clicking on the “Checkout” button and then entering your personal data, all relevant data, including the shipping costs, will be displayed again on the following page. By clicking on the “Continue” button, you will proceed to the next step of the ordering process.

2.4 Before submitting your order, you can review all details such as items, name, address, shipping, etc., and select your preferred payment method. You can also cancel the order process at any time or return to the previous step.

2.5 By clicking on the “Buy now” button, the buyer submits a binding offer to purchase the items stored in the shopping cart. Before completing your order, please read our General Terms and Conditions | Consumer Information, Cancellation Policy, and Privacy Policy, which you can access again via hyperlink, save, or print using your browser's print function.

2.6 The buyer is bound to their offer for three business days. If the seller does not accept the offer within this period, the offer is deemed rejected. The decision on whether to accept an order is at the seller's discretion.

2.7 The buyer's offer is accepted by sending a separate order confirmation by email, in which the acceptance of the order is expressly confirmed. If it is not possible to deliver the goods you have ordered, for example because the goods are not in stock, we will refrain from issuing a declaration of acceptance. In this case, no contract is concluded. We will inform you of this immediately and refund any payments already received without delay.

 

§ 3 Storage of the contract text

The contract text is stored on our internal systems. You can view the General Terms and Conditions at any time on this page. You also have the option of saving the offer pages on your hard drive or printing them out using your browser's print function. The order details and the General Terms and Conditions will also be sent to you by email. Once the order has been completed, your order details will no longer be accessible via the Internet for security reasons.

 

§ 4 Error correction

All fields marked with a red asterisk must be filled in. If any information is missing, a corresponding message will be displayed. As long as you have not confirmed your entries in the ordering process, you can correct any errors by clicking the “Back” or “Cancel” buttons. You can also cancel the ordering process at any time, for example by closing the browser window. Only by clicking the “Buy now” button does the buyer confirm their entries and submit a binding offer to purchase the items stored in the shopping cart.

 

§ 5 Contract language

Consequences of revocation

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods. You shall only be liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties, and functionality. Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded, for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery, for the delivery of goods if, due to their nature, they have been inseparably mixed with other goods after delivery, for the delivery of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence, for the delivery of audio or video recordings or computer software in sealed packaging, if the seal has been removed after delivery for the delivery of newspapers, magazines, or illustrated magazines, with the exception of subscription contracts.

 

§ 7 Cost-bearing agreement when exercising the right of withdrawal

The buyer shall bear the regular costs of the return shipment if the delivered goods correspond to those ordered.

 

§ 8 Shipping

8.1 Shipping region: Delivery is only available to addresses within Germany and the EU. If you do not specify a different delivery address, delivery will be made to your billing address. Unfortunately, delivery to PO boxes is not possible.

8.2 Shipping service providers: Your order will be delivered within the EU by DHL as insured parcel shipping with tracking. Within Germany, we deliver with DHL and HERMES. With tracking and insured.

8.3 The seller shall not be responsible for delays in delivery and performance due to force majeure and events that make it significantly more difficult or impossible for us to provide the service, such as strikes, lockouts, and official orders, war, unrest, expropriations, storms, floods, and other natural disasters, as well as power or system failures through no fault of our own.

8.4 For entrepreneurs: Delivery is made at the buyer's responsibility if the buyer places the order in their capacity as an entrepreneur.

 

§ 9 Shipping costs

The shipping costs (packaging, insurance, and postage) for shipments within Germany are €5. No shipping costs will be charged for orders over €48.

For shipments to other EU countries, shipping costs of €15 will be charged. These costs are waived for orders over €150.

§ 10 Prices

10.1 Prices: The prices quoted on the day of the order, which are communicated to the buyer before the order is placed, shall apply.

10.2 All prices are quoted in EURO and are final prices. The seller makes use of the small business regulation of § 19 (1) UStG (German Value Added Tax Act) and therefore does not charge sales tax.

10.3 Delivery and shipping costs are not included in the purchase price quoted. These are shown separately and may be payable by the buyer in addition to the purchase price.

 

§ 11 Zahlung

11.1 Zahlungsarten

Die Bezahlung erfolgt wahlweise per Vorkasse oder über das Zahlungssystem PayPal. Eine Zahlung auf Rechnung ist nur nach vorheriger individueller Vereinbarung möglich.

11.2 Direkte Banküberweisung (Vorkasse)

Bei Auswahl der Zahlungsart „Direkte Banküberweisung” ist der Rechnungsbetrag innerhalb von 7 Kalendertagen nach Zugang der Bestellbestätigung als Vorkasse auf das angegebene Konto zu überweisen. Bitte geben Sie im Verwendungszweck Ihre Bestellnummer an, damit wir Ihre Zahlung korrekt zuordnen können. Die Bearbeitung und Auslieferung Ihrer Bestellung erfolgt erst nach Zahlungseingang. Erfolgt innerhalb der genannten Frist kein Zahlungseingang, behalten wir uns vor, die Bestellung ohne weitere Erinnerung zu stornieren. Ein Anspruch auf Lieferung besteht in diesem Fall nicht.

11.3 PayPal

Zahlungen per Kreditkarte oder Lastschrift werden über den externen Zahlungsdienstleister PayPal abgewickelt. Bei Auswahl dieser Zahlungsart werden Sie nach Abschluss der Bestellung automatisch zu PayPal weitergeleitet. Dort können Sie entweder als Gast bezahlen, ein neues Konto eröffnen oder sich mit Ihrem bestehenden PayPal-Konto anmelden. Die Ware wird versendet, sobald uns die Zahlungsbestätigung von PayPal vorliegt.

11.4 Zahlung auf Rechnung

Nach vorheriger individueller Vereinbarung kann die Bezahlung auch auf Rechnung erfolgen. Voraussetzung hierfür ist, dass die Lieferadresse mit der Rechnungsadresse übereinstimmt.

In diesem Fall ist der Rechnungsbetrag innerhalb von 14 Kalendertagen nach Erhalt der Ware auf das in der Rechnung angegebene Konto zu überweisen. Bitte geben Sie im Verwendungszweck Ihren Namen und die Bestellnummer an. Achten Sie darauf, unterschiedliche Bestellungen separat zu überweisen, damit Ihre Zahlung korrekt zugeordnet werden kann.

Die Zahlungsmodalitäten werden bei jeder Bestellung neu geprüft. Es besteht kein Anspruch darauf, dass bestimmte Zahlungsarten jederzeit verfügbar sind.

Die Bankverbindung wird Ihnen in der Rechnung nochmals vollständig ausgewiesen.

11.5 Zahlungsverzug

Sofern keine abweichende Zahlungsfrist gemäß § 11.2 oder § 11.4 vereinbart wurde, sind Zahlungen innerhalb von 14 Kalendertagen nach Vertragsschluss zu leisten. Erfolgt innerhalb dieses Zeitraums keine Zahlung, befindet sich der Käufer in Zahlungsverzug. Es gelten die gesetzlichen Bestimmungen zu den Folgen des Zahlungsverzugs.

§ 12 Retention of title

12.1 The seller retains ownership of the delivered goods until the purchase price for these goods has been paid in full.

 

§ 13 Warranty

All items in our online shop are subject to statutory warranty rights.

 

§ 14 Governing law

German law applies.

 

 

The following provisions apply only to commercial and public-law customers. The following provisions (Sections 15 to 18) do not apply to transactions with consumers.

 

§ 15 Offsetting

For entrepreneurs: Offsetting is only permissible if your claim is undisputed or has been legally established, or if the offsetting takes place in legal proceedings.

 

§ 16 Transfer of risk

For entrepreneurs: The risk of accidental loss and accidental deterioration of the goods shall pass to the buyer upon handover, in the case of sale by delivery to a place other than the place of performance, upon delivery of the goods to the forwarding agent, carrier, or other person or institution designated to carry out the shipment.

The handover shall be deemed to have taken place if the customer is in default of acceptance.

 

§ 17 Right of withdrawal

If the customer is purchasing in their capacity as an entrepreneur, the right of withdrawal that exists for consumer goods purchases does not apply.

 

§ 18 Place of jurisdiction

For entrepreneurs: The place of jurisdiction is the local or regional court responsible for Berlin.
